I suggest adding a "vitage keys/vintage synths" option to this poll. 
I suggested a ROM like this way back when, and am still hoping we see
something like this.

I thin he means like Pattern Call functions ala Roland. �You hit a button and one of the keypads, and the pattern you assign to that pad is selected to play next. �It's useful for organizing a live set, as you don't need to go scrolling through your patterns, you just hit a keypad to call up the next one.

Yeah, that's exactly what I meant. Instead of sequentially scrolling through them.

Well, hit up the survey, but while filling it out realized something.
 
First off, I could answer the survey in two ways.  The first was how I truly felt EMU should work things, in which case my answer would come out as IT SHOULD BE FREE.  Were not dealing with installing a new chip or anything I'm assuming here, and really, when it comes down to it, it has only been under such circumstances that I've ever felt right about paying for a new OS for a piece of gear (which is the 777); which even then, have to admit that I felt the price was pretty darn fair.  I mean damn, part of the advertising behind the Command Stations was that future upgrades would be available free!
 
Now though, when it boiled down to it, I ended up answering in a different way, which was simply what I'd probably be actually willing to do (leaving out the fact of if I felt it was fair or not).  In this case, I end up be willing to make some payment (while also ending up pretty ticked at EMU).

Who really wants to say how much they are willing to be played for a sucker? Fairness means a lot. Who wants to participate in some mass negotiation with E-mu? If so, let them make the first offer. Sorry, Creative is a huge (and possibly evil) company. They marginalized Ensonic (who?) and they are diluting E-mu to the point that I wonder whether they will be around in a year. When I get call from Creative for my E-mu sound card from a woman reading lists that doesn't really seem to know what going on (that was a month ago, where's my goddamned ROM?!!) When all the synths never progress but are rebranded Soundblaster in new and various colors the musicians will run away, but when the consumers will move in, Creative will make more money and tough luck to all y'all.
 
Just a dire opinion/prediction I hope won't happen, but worse things do.
 
Sure its a competitive market, but when the main individual behing making the cools synths in the first place drops it and is now into "soundcards" well, what went wrong? Perhaps in a few years that individual will wake up and put out his version of the Adrenalinn or the Evolver synth too. Waiting.

I have to agree with you on this one. I got the same \u201cphone call\u201d regarding the free ROM, and now I am unable to get that same woman on the phone. I leave her messages... no return calls. Now when I contact Creative, they so they have no record of my ROM rebate form. Fucking lovely. They lost it, but blame me. Now I need to go through all sorts of hoops faxing and mailing all sorts of junk just so Creative knows what the heck a free ROM is, and if they can send me one months after this deal expired. Obviously this woman who called me had the form in front of her. 5 months, no ROM for us. I do appreciate Sean\u2019s efforts in informing us about the free ROM fulfillment issues, and who to contact. But it\u2019s going nowhere.

I barely even fire up the XL-7 anymore. I may just sell it. I know I will be losing out, but I donR17;t like where this is all going. And I am more than a bit p\u2019ed off about the free ROM that was a deciding factor in my purchase of this product. I am very happy with my new Yamaha DX200 and AN200. And also with some of the developments going on in the Korg OASYS land.

I learned a lesson, I\u2019ll know better next time. I won\u2019t be a sucker and pay for anything more.

Why? Is it broken? Is it no longer doing what it did when you bought it?

I'm a little concerned about getting bugs fixed, and about any
proprietary hardware maintenance I might need down the road, but in
the grand scheme of things, freebie sound ROM's are some way down the
list.

  o A way to see if a Preset is saved in Pattern or not as you scroll through them in Preset view.  This would make it easier to free up memory and overwrite User Presets that are no longer being used.  Similarly, a way to erase or reset all unused Presets at once. 
  o The ability to record or enter Track Mutes in a Pattern and Song 
  o A means to select and add a measure of silence at the end of a Pattern while in real time record mode.  this would allow you to avoid writing over the beginning of a Pattern when it loops around. 
  o Real-time preview of quantize settings in Pattern Edit so you can hear your changes as you make them, as well as new Groove Quantize features. 
  o An Undo (Revert To Saved) keyboard shortcut, to make undoing a bad take easier and faster.

  o Real-time erase with range selection. Instead of having to hold the actual notes you want to delete while in real-time record, you should be able to hold the highest and lowest notes and everything in-between that range will get deleted. 
  o The ability to turn on a feature that would let all actions send out sysex data.  
  o The ability to stop at a certain measure while in grid recording. 
  o A way to set up markers within longer Patterns, so that only the measures within that range will loop, making editing sections of larger Patterns easier.  
  o The means to a shift an entire track by a certain amount, ticks and quarter notes.  
  o The ability to jump to a new Tempo without having to scroll to it, similar to the way Pattern Selection works during Playback. 
  o A means to filter different MIDI information before it gets sent to the MIDI outs, IE filter out program changes, CC's, etc. 
  o Fix the existing bugs first. 
  o The ability to specify whether Preset and FX Send information is also copied when you copy a Track to a new Track 
  o The ability to burn ROMs directly in the XL-7, without the need for an Emu sampler.  
  o A Preset Editor and/or Librarian included as part of E-Loader, so that user don't have to rely on sysex dumps for their Preset management.  
  o The ability to select whether the XX-7 will let the selection of a new Pattern change the tempo to the value saved with that Pattern, instead of having the tempo remain the same from Pattern to Pattern while playing back.  
  o The means to swap out tracks from other patterns during play back, allowing you to slowly morph from one pattern to another on a Track by Track basis.  Similar to Megamixing.

I agree, add that choice! My entire entire past 9 years of musical strife
was all lit by the imagination of OTHER PEOPLES MUSIC.

Of course, since then, I just wait as my subconscious psyche builds and
writes it's own music, and when it's ready it channels it through
me...usually at the worst times of course. But listening to great music is
still my best inspiration to date.

Problems with ARPS using Sonar

Hi there,

My situation is this.  I've got two sounds I'm trying to use simultaneously.  I've got two sequences both coming from Sonar 2.0 XL (EX?) anyway, they are sent to channel 1, and channel 2.   
The weird thing is this, my arp pattern will only play if both sounds are set to ARP = ON, or if the other track is muted in Sonar.

I'm trying to have one sound playing with no ARP, and the other with.  But for some reason, Sonar seems to be stopping it.

Any input would be much appreciated.

I have deleted this poll.  If it was only in jest, then I apologize.  If 
it was in seriousness, then I took it as a sign of disrespect against 
someone who has gone WAY out of their way and job responsibilities to make 
this list and the product it's based on in a league of it's own.  The new 
OS is coming and I can personally attest that the wait will be worth it, 
lot's of really cool features being added (and currently being bug 
tested), so be patient.

Sounds like you're planning on giving away samples from your World Rom? 
Just a suggestion, but you might want to contact EMu about the legalities 
of doing this before you use a list frequented by them  (and the World 
ROM's creator, vibesart) for advertising this.  I could see them taking 
offense...

the product in question is being discontinued (I will be pulling the

You should clear it with E-mu.  They hold the rights for the samples. 
And yes, they are copyrighted and I would assume will be released for
Emulator-X.  I would be very much surprised if you wouldn't get sued,
or at least sent a cease and desist.  Just a warning...

Copyrighted samples: legal issues

Any lawyers out there?  If so, help me out here.  (Or anyone else who 
knows the answer.) Aaron's comment touches on an issue I have 
wondered about.  

(1) If samples (and perhaps other components that come packaged on 
electronic music-making gear) are copyrighted, and
(2) if I make, distribute, and/or sell music using those samples (and 
other e-music gear components,

No.  You have usage rights that allow you to use the sounds.  You
don't, however, have the rights to resell them as is.  I'm trying to
think of a similar example, but I'm not succeeding at the moment...

A while back edrummer.co.uk had a similiar problem with Roland. He recorded
audio loops of himself playing Roland V-Drums and put the files on his
website for people to use. Roland objected because the loops allowed people
to cut and paste individual hits into other applications/equipment. The
samples used in the V-Drums were licensed from Spectrasonics, the license
was such that end users could use the sounds to make their own original
recordings, but they couldn't re-record and distribute them "as-is". The
main issue for edrummer.co.uk was that although Roland had agreed to the
terms of this license, they had failed to inform him of its existence,
neither at the time of purchase or later, yet he was expected to comply with
it.

It was a while ago, and my description of the events is not perfect, but I
hope you get the gist of it. If you're interested in what the outcome was,
you may be able to find out more on edrummer.co.uk (something like that), or
on the forums over at www.sound-on.sound.com

In the current situation, it is a Aaron says - you can use the samples to
make your own original compositions, but you can't distribute them as-is.

sounds are not available for purchase, I'm opening a channel to 
those who need a sample pack or two. The moment the new audio cards

I know you're not *trying* to do a bad thing here, but I just thought
you might want to know it's not legal.  Whether you choose to do it or
not is up to you.  Kinda like just because a book is out of print
doesn't give you the right to go down to Kinkos and start printing
copies.  Don't make me come over there and fork under your coil
again... =)

On a side note, and due to the equal amount of force pushing 
against releasing the World Expedition packs, I will likely not be 
doing so. However, I may be compiling custom packs of effect-laden

I really don;t want to get into a pissing contest with you, Sean ... 
but I would like to know under what legal principle or mutual 
agreement you are making these threats?

I just checked all of the material shipped with my MP7, Halo and 
additional ROMs ... there is no restrictive license - "shrink wrap" - 
or otherwise ... anywhere.

It seems to me that you MIGHT have a case were someone to find a way 
to digitally rip the actual samples from the ROMS and resell them ... 
I'd support Emu's right to protect their intellectual property in 
such a  case.

But people have been sampling drum machines (and other electronic 
instruments) for quite some time now. There are several sample sets 
sold or offered free of Emu Drumulators, SP12s, etc. ... why no 
action in those cases? It is in fact an "intended use" of such 
equipment. There is ZERO case law supporting the notion that you can 
forbid such activities, absent any restrictive license agreed upon by 
both parties.

Forbiding - or even threatening legal action - against such customary 
and intended use of your products is (at worst) possible grounds for 
RICO action. At best it's antagonistic against your customer base, 
who wish only to use the product they purchased in a customary manner.

Again, I am not trying to just throw barbs at you ... no animosity 
here I assure you.

You might want to discuss this with Emu's legal dept.

IANAL, but this sounds like one of those legal gray areas, where the 
legal argument is along the lines of "it is a copyright infringement 
to resell samples as they are, unchanged", and the question 
becomes "how different is different enough to be legal in the eyes of 
the law?"

I can only speak for myself, but if some venture I was thinking of 
taking on fundamentally puts a copyright holder on the defensive, 
with only a foggy legal argument between me and a subpoena, I'd 
expect the long-term hassle to FAR outweigh the potential profit 
(which, in the case of sample CDs would probably buy you a cup of 
coffee and a book of stamps).

In other words...is it all worth it?

Side note: While typing this, I was remembering the serious price and 
ultra-serious copyright/EULA stuff I had to read and agree to when 
buying a sample CD set from Spectrasonics.  They make E-mu look like 
anarchy.  Spectrasonics expects to be credited on any commercial 
release in which their material was used.  I wouldn't want to get on 
the bad side of their legal team!  Jeez!

No legal arguement to have I'm afraid.
You could sample form the analog / SPDIF outs patches for personal use which you would then loop/multisample
and generally mangle yourself.
Hence why you can sample that 808/909/303/CR78/JUNO etc etc etc  
That said I could not use the schematics and identical circuits of said units and build my own version full general distribution under another name.
If you where to RIP Emu's roms as it was so eloquently put you'd be taking the hardwired copy ,raw waveforms ,loopoints ,processing and all.
Quite clearly an infringement of said LAWS for those very same reasons.
Go ahead RIP enough DVD's from ones you've purchased and start selling them online and see what happens to you.
What's so goddam anal about it.
Quite frankly I don't blame EMU.
Especially after the Curtis filter chip fiasco & Sequential (Prophet 5) - nearly sent them bust. 
Who designed and made the Curtis Filter Chip - EMU no patent etc etc Sequential and several others made a bomb off EMU's tech back with that chip alone. I mean how many people could afford an EII+HD in 84'
Hence the patents now placed on Z-plane/12th order filter technology.
Ditto RIPPING the roms themselves.
You could quite easily program your own patches using your MP-7/XL-7/PX-7 and manufacture a sample CD of all original material for personal profit as a business enterprise adventure.
Then I could RIP it flog it of for next to nixx in huge volumes and hear you bitch about intellectual property.

Don't worry this wont be a pissing contest. Hey we build samplers, we know the fine line of sound
copy protection. My advise, don't come into a forum announce you are going to distribute factory
sounds, free or not. I can't take a blind eye when it's that blatant. Other than that, I'm not going
to get into details of any legal actions we have taken or have not. Bottom line, if you have a
sampler, for gods sake use it and sample away. Distribution is when things become complicated. BTW,
all the riffs and patterns are yours, the users, do with them as you like.

Hi Sean

Just a quick question if you can, as I really don't know the fine 
lines, and there has too much discussion on KvR ( and elsewhere)on 
this, so i don't really know the scoop.

ok..here goes:

If I do an original patch on my MP7 ( using several ROMS as sound 
sources) with my own filtering, envelopes, ect...can I sample this 
as my own?

What I am thinking of is doing a sound set for Camel Audio's 
Cameleon, which is basically a "re-synthisizer": it takes a wave 
file and extracts the data from it and converts it to it's extensive 
additive engine. From there it can be further processed with it's 
filters, envelopes, ect.

I suppose another fine line. But would like an answer from the EMU's 
mouth :-)

Just so you know, I fully support Emu's right to protect its 
intellectual property. The overall quality of Emu's sample library 
has always been excellent, and that should be rewarded with sales, 
not thievery.

It bothers me quite a bit however that I now don't know the "line" 
regarding Emu ROMs, and what rights may or may not be claimed by Emu 
at some future date based upon whatever winds might be blowing at the 
time.

Among other things, I DO create custom sample sets for some clients 
for use in various samplers. I would never simply rip a factory patch 
from anything ... that's just plain dishonest as hell, and would be 
shytty service to my clients as well. But if I create a particular 
kit for something like Battery or LM4, based upon PX7 samples (and 
often other things crossfaded, velocity-switched) but clearly NOT a 
factory PX7 patch ... where does that put me?

This concerns me so much that I searched all of my Emu Command 
Station, Ensoniq Halo and Emu ROM manuals for ANYTHING like a 
copyright notice on the included sounds ... nothing there even 
remotely close. Nothing on Emu's website either. But then here you 
are making a copyright claim in this forum ... it just contributes to 
so much misunderstanding and mistrust.

Allen,
The only issue is distribution, and the way it was being presented that started this thread. It
sounds like everything you are doing is fine. You are using our products in a way many of our users
do. I don't see any reason to be alarmed. If you intend to sell or mass distribute (web down-loads
for example)  E-MU Samples without our permission, that's  when we will become interested in what
your are doing.

Sorry, I think I caused some confusion in my own wording - 
by "ripping", I didn't mean actually taking every sample wired 
straight from the ROM - I was referring to making sample sets, which 
consists of recording them via analog and then re-EQing them. Not 
taking them precisely as-is, so to speak.

Well, let's be clear here ... I said it was a *worst case" scenario. 
What would call it when an enterprise sells a product, and then 
forbids its customers to use it in a customary manner, threatening 
legal action absent compliance?

Among other things, the Command Stations are all synthesizers ... 
capable of producing all kinds of different sounds. That's what they 
are MADE for. There are all manner of companies creating sampled 
sounds from various synthesizers and then SELLING the resulting 
material.

Emu happens to be one of those companies. My Emu ROMs containing 
samples from Moogs, Arps, Oberheims, Mellotrons, Prophet 5s, 
Fairlights, etc. ... I doubt seriously that Emu has any "permission" 
from the ... ahem ... "copyright holders" of that "intellectual 
property".

But they will - so it seems - turn right around and forbid you or I 
to do the same. Did you sign any kind of restrictive license with 
Emu? I sure didn't. Have you been able to find any copyright notice 
on Emu's sounds in any of the material shipped with your Command 
Station or ROMs? I sure didn't.

But here in this very forum a representative of Emu is making threats 
against anyone who would engage in the precise same business 
practices that Emu itself does ... namely sampling synthesizer sounds 
and selling the resulting material. So, it's "fine" when they do it, 
but "criminal" when you or I do?

Give me a freakin' break.

again...

Ripping the samples out one by one, repackaging them, and
redistributing them is NOT customary use, and is NOT LEGAL.  Period.

Remember here that the copyrights are on the SAMPLES, not the synthesis
engine.  You're getting confused between the synthesizer and the source
material.  Under your argument, you'd be able to sample your CD player
playing the newest CD, burn copies, and redistribute them.  Obviously
illegal.  "But I'm just sampling my CD player, not the music" you cry. 
Right.  Try that with the RIAA.

The reason you can sample a Moog synth and resell it is because you're
not sampling source material.  You are creating something, then
capturing it.  Just the same, you couldn't copy the factory presets of
that synth and redistribute them on a floppy.  Source material vs.
final product.

There's nothing stopping you from creating new sounds, sampling them,
and reselling them.  You cannot, however, sell the original samples. 
Of course, this is where the fine line is.  At what point is it "new
material"?  Is putting an exciter on the raw samples enough?  Probably
not.  Is running it through the synthesis engine, applying effects,
etc?  Probably.

If you had been keeping up on this discussion, you'd know that I 
agree with this point. You'd also know that it is clear that nobody

One important differnce is that the CDs in question all have a clear 
copyright notice printed on them. The other important difference is 
that - again - nobody is suggesting just ripping the samples and 
selling them. I certainly don't do that, and I hope nobody else in 
this forum does either.

The other important distinction - again - is that I am not suggesting 
any such direct "ripping" of samples. Even if it were legal, it's 
sure-as-hell unethical.

Well ... maybe. Yamaha (for instance) holds a patent (or an exclusive 
license from Stanford, I forget which) on FM synthesis. This is why ( 
I am told) NI pays a license fee for FM synthesis, and why FM7 costs 
as much as it does comapred to their other emulations.

Also, where do you draw the line? If I open up the filter on a Emu

Well, fine ... that's exactly what I do, and what I think has been 
suggested on this forum by others. Isn't irksome however, that the 
most you feel comforatble saying is "probably" or "probably not"? 

I take Sean's statements to mean that everything I am personally 
doing to be "cool" as far as Emu is concerned. I certainly don't plan 
on ripping off the original samples and selling them.

A CD (nor any other work of art affixed in a medium) need not have

This may be true, but has nothing to do with sampling a patch of 
your own made from a DX7 or a FM7 which is completely legal and for 
which Yamaha can do nothing about under any law I know of. The 
reason that Yamaha may have to be paid a license fee would be if NI 
were using Yamaha's *patented* method *or* Yamaha's copywritten 
code. Both things are or may be the case and while different from 
each other (patent and copyright I mean) essentially boid down to 
the concept that you can't use something that belongs to another. 
Same for samples. But not the same as an original patch made on a 
patented invention like a DX7. Again, you will have to resort to the 
actual laws for verification of this statement--I don't have time to 
quote you line and verse of the statutes.

I would argue that this is a new patch and your original. Another 
might argue that even if many of the parameters are different 
values, if it sounds the same, it is the same. There former applies 
a bright line which is generally good at the expense of a major 
loophole. The latter interpretation asks for fairness a the major 
cost of uncertainty, which is, in my opinion, worse thant the 
former's loophole. The law on this generally differs depending on 
whether you are talking about samples or patches. FOr a sample made 
by me and affixed on a medim by me, for which I therefor own the 
master recording of, you can process it anyway you want, but if I 
can *prove* that your result was lifted from my sample, I win. In 
the case of a patch, it is a different inquiry. A patch is more of a 
recipe, i.e., a formula that can be broken down in to a list of 
parameters and their respective values. Such a recipe either is or 
is not identical to another recipe (patch). More filter equals a 
different recipe, therefore not a copy, even if it sounds the same. 
The distinction is that patches are only fairly compared by looking 
at their recipes and not how they sound. To see why this makes 
sense, consider the opposite: If it was about how a patch sounded 
then one could be sued for making an identical sounding patch on one 
synth to a patch on another. That would make no sense. One can even 
make an identical sounding patch on the same synth often by using 
wildly different methods. An owner of one should not be able to sue 
the maker of the other, right? Anyway, as far as I know, the law on 
this is unsettled and there are lots of scenerious that have not 
been tested. For example, even if a patch is different from another 
if filter cuttof value has been changed from 125 to 126, and for one 
patch no court would rule any copyright infringement, what would 
happen if someone took a whole commercially released patch set for a 
synth and minorly modified each patch including the names and 
released the same set themselves. Extrapolating from the first 
example, one might argue that such a new set was not infringing. On 
the other hand, the extreme unfairness in this might be enough for a 
court to depart from the law and apply equity, under which almost 
anything can happen. Anyway, I don't think such a case has come up. 
Therefore the answers can only be reasonably guessed at with maybes 
or maybe nots.

That may be irksome, but it is a fact that it is likely (another 
qualifier) undecided in the way it is presented. See above

No that's cool. I don't even have the rom yet! I will review it once I get it though. I am interested to see what E-Mu did with the parts of it that are based on Ensoniq's Urban Dance Project ROM since I have that in my ASRX and think it is really great. I don't know about the world sounds, but I am hopeful they will be nice.

Yeah, I just posted the poll to appease Yahoo.  I spent nearly a half an hour on the phone with them yesterday, trying to get a live person in the groups department.  After hassling the "small business billing" group for a while, they told me to fill out this form which I had done before, but maybe this time they annotated that I bothered them for so long.  =)

Bottom line is that we get *someone* that's still around!

Ok... yes, I'm in an 'altered state' that has little to do with music right now, but I think I'd be paranoid about this even if I was sober... but could somebody help a stoner out and tell me in plain, simple english... am I SUPPOSED to be powering down my XL-7?  It's kind of thrown in there like a joke at the end, and it's got me all worried, because I hardly every power mine down... unless I need to unplug it for something... this isn't bad, is it?
