The Current Legal Discussion: Drawing Fine Lines: Samples & Presets

I like a good argument as well as the next guy, so let me chime in
here.

I wrote two responses earlier in the week but did not send them
because I thought they might inadvertantly contribute to animosity.

For the record, good arguments (1) use sound logic, and (2) do not
use ad hominems, invectives, hyperbole, etc.

I hope the discussion continues. It is worthy of discussion.

Gloves off:
Last night my friend came over to ours with a Gibson Les Paul guitar.
We sampled a middle c into an Emu e64 sampler.
We then sold it to a composer who then sold it on to a dj who remixed
it and he got to number one hit with it!.

Serious Question 1:
Who pays whom the royalties?

Serious Question 2:
On the issue of >sampling<-- how can anyone have "intellectual" rights
on a sample?

...and my last (not so serious)question :Does anyone here feel GOOD
about suggesting that people who participate in enjoying (let alone in
CREATING) the audio ARTS - is a CRIMINAL?

FYI
 >>>>>Its called Evolution<<<<<.

If I hear that from an EMU employee ( a company that markets samplers,
of all products) then I lose some respect I have for the company that
made a great live sequencer with a great synth engine - (allbeit with
overpriced sample ROMS!!!!!) in the xx7.

So please, have some respect for us xx7 users in this forum, because
we´ve already shown our respect to you by parting with plenty $$$$$ to
buy your product.

Sorry about the rant! When´s the next OS upgrade BTW?

Paul the ad hominem, invective, hyperbolic agitator.

LOL

You have to be fast in the bussiness if plagiarism.
What took the most time was arguing who got all the $$$.

But seriously. It really is a fine line to draw and not even a straight
one at that:

"If nature has made any one thing less susceptible than all others of
exclusive property, it is the action of the thinking power called an
idea, which an individual may exclusively possess as long as he keeps
it to himself; but the moment it is divulged, it forces itself into
the possession of everyone, and the receiver cannot dispossess himself
of it. Its peculiar character, too, is that no one possesses the less,
because every other possesses the whole of it. He who receives an idea
from me, receives instruction himself without lessening mine; as he
who lights his taper at mine, receives light without darkening me.
That ideas should freely spread from one to another over the globe,
for the moral and mutual instruction of man, and improvement of his
condition, seems to have been peculiarly and benevolently designed by
nature, when she made them, like fire, expansible over all space,
without lessening their density at any point, and like the air in
which we breathe, move, and have our physical being, incapable of
confinement or exclusive appropriation. Inventions then cannot, in
nature, be a subject of property." - Thomas Jefferson

They have come for your uncool neice

You'd look nice as a drawstring lamp
Don't you worry, it's only a shower

(1) Welcome back.
(2) Glad your new setup works.
(3) I get the royalties on a technicality because I filed the
documentation correctly by changing the name of the thread to "The
Current Legal Discussion: Drawing Fine Lines: Samples & Presets" from
something about a new xl-7 poll.

Public Law 401-XL7: "He or she who files the paperwork correctly
gets the money." (Not sure if that's at the gov website posted on
this subject.)

(4) You should have been here BEFORE the flaring virtual tempers
cooled a bit!!!

Beat Garden

2004-02-25 by Matt Picone

I got the Beat Garden ROM tonight. It's fantastic! The percussion sets
alone are worth the price. The vox programs are also excellent, as are
the pads and basses. This board is loaded with character.

It has a lot of BTS programs though, which I never use. Is there some
way to disable the auto play feature of these to turn them into regular
programs?

Turn beats mode off. 8th screen in the Arp menu (it used to be the
Arp/Beats menu...) and turn "P" (for "preset") to "off".

Hehe, the comfy chair route is great no? I recommend a pair of the enw
Shure E2 headphones, they work great! Total isolation from ouside nosie
if you use the foam ear pieces, and excellent sound too.
