Copyrighted samples: legal issues

Any lawyers out there?  If so, help me out here.  (Or anyone else who 
knows the answer.) Aaron's comment touches on an issue I have 
wondered about.  

(1) If samples (and perhaps other components that come packaged on 
electronic music-making gear) are copyrighted, and
(2) if I make, distribute, and/or sell music using those samples (and 
other e-music gear components,

am I violating copyright (or any other)laws?
