I am not a lawyer.  But doesn't this look like fraud or theft?  That is 
a matter for the police.  You would need evidence that a) an agreement 
was made to purchase some items, b) the buyer sent the money and the 
seller received it, and c) the goods were never delivered.  That does 
not seem too difficult to show.  You have a record of emails and money 
transaction records.  It doesn't cost anything to contact the police and 
ask.
