Hi all - I came across the following documents on the Intellectual Property Office website. http://www.ipo.gov.uk/types/tm/t-os/t-find/t-challenge-decision-results/o45911.pdf http://www.ipo.gov.uk/types/tm/t-os/t-find/t-challenge-decision-results/o46812.pdf Reading through the legal jargon (that I don't understand !), does this mean Dave Simmons has regained the rights to the Simmons name from Guitar Centre ? If so, :-)

While I am not a lawyer, I do have some experience with business law. I have spent the past hour reviewing these 2 documents. It would appear that there was a ruling against Guitar Center for their bad faith use of the Simmons name on electronic drumkits with 3,000 GBP to be awarded to Dave Simmons. Guitar Center filed an appeal which was shot down, and the payment to Dave Simmons was increased to 4,500 GBP. So, it does appear that Dave has the rights to Simmons once again.

Brilliant news if Dave Simmons has the rights back. If so, it would be great if he could do something similar to Tom Oberheim and launch some modern versions of instruments such as the SDS V.

That looks to be some great news. Reading through that makes it look like Guitar Center never did "Buy" the rights to the Simmons name and that they had no right to market anything using the name. I remember when I first heard of the new "Simmons" drums, I raced to GC to check them out. I was very excited until I actually played on the set. I was pretty disappointed at the quality and unjustifiably lost a lot of respect for the Simmons name. I thought they were just trying to cash in on a past reputation. Little did I know it was GC trying to cash in. I do admit I bought that 1st generation set, but sold by Sam's Club under the Koncepts brand. The only reason being is I wanted a set to play on where I didn't have to disrupt the house with load music. It wasn't long after though, I searched to find an original SDS9. The second document is from November 2012. I can imagine that there's some debate regarding this issue on US soil, but hey, it feels good to at least talk about it and see the ruling in favour of Dave here in Europe. We don't see any "China-Simmons" here these days. I'm also very glad one passes unsold on Ebay... I do hope he returns with something new. With Benj returning under the 2Box name after Clavia sold off the DDrum name, Clavia re-entering the market with the Nord Drum, Korg re-releasing the Wavedrum with much needed updates and reasonable pricing, and Vinny and his SDX replacement the Mandala drum, there is a market for Dave's products and concepts. it is Danny not Vinny :) The very last Simmons product (never released I think) it was a mix between the SDX and the Portakit (I have the brochure somewhere)would be completely outdated today but it was a great idea back then. But the tendency to re-vamp old gear with a fantastic price, analogue soul and MIDI! it is great, the Korg Mini MS20, the Korg Volca clones of the 303 and 606, obviously the Nord drum 2 with the pad and all for pennies! No too many people can afford £2000 and up prices anymore, just a few only, then next month the question will be "why to pay £2500 for a 303 when I can get it for £100 with midi and very relieable components and warranty" I know is not the same but £100 is a price we all can afford... FYI: Vince De Franco is the inventor of the Mandala, Danny Carey is the player and contracted Vince with idea on what he wanted.
