I don´t know US laws regarding Brand names but could it be that enough time has passed for the name to be considered up for grabs ?

we often wondered about copyrights & that sort of things ..
 here is the message from Dave , that makes it clear on that Guitar 
centre trouble ;

Hi Patrice.

You have probably seen the SD5K kit from Guitar Centre in the USA?
Here's the link: http://www.simmonsdrums.net/sd5k/ 
Well, this was as much a shock to me as it is for everyone else 
interested in electronic drums. I have not sold or authorised the 
use of the Simmons name or logo on anything, let alone that cheap 
Medeli kit from China. Guitar centre have stolen the name to give 
the kit an instant visibility in the market place. 
 
This has really upset me, and I have instructed lawyers to take 
legal action against Guitar Centre. Please can you pass it around 
the Simmons forums and various websites that this kit is nothing to 
do with me. I would hate to think of Simmons fans looking at the 
kit, or even buying it on the basis that it might be something 
different or special. It is a bog standard Chinese kit that is being 
manufactured and badged under all sorts of names.

Wow a reply from the man himself...brilliant.

I hope this kit and everything associated with it gets its arse
kicked. I cant believe they had the nerve to blatently rip off the
name and the logo.

Dave, I wish you were still making drums mate!

Good point, especially if someone else legally owns the name, why not flood 
the market with schematics so all old stuff cab be repaired and business 
worsen?! >:)

e.g. "Zimmonz" or "5immon5" to distribute the schematics for free,

Probably the forms to press the SDSV pad shells probably still exist
somewhere? Together with the knowledge of some techies in this group a
remake of a 5immons 5D5V in limited edition might be possible? (-3/4
joking- at least some of us would be glad to replace some shells one day)

I think now is the time bring back Simmons drums!!

Assuming Dave is OK with this and also assuming that Dave would play 
a part in it - why not set up a company to carry the legacy forward.

I say the name has to be 'Simmons' if only because demand would 
dictate that we would win in a battle of names (also, is the US Trade 
Mark worldwide? - or just US, if US we could patent the 
designs/logo's etc in Europe and build up such a demand for new 
products that we'd blow away the competition anyway)

I think that, between us (those that are interested and have the 
necessary knowledge/ability) we can develop a 'new' version of the 
SDSV (perhaps SDS5000), with the old style pads, in digital, with 
midi and with a software element (that could sell separately) with an 
emphasis on synthesis as oposed to sample playback (much in the same 
way that keyboards have developed)and with an element of inovation 
and steeped in heritage. Im sure that it would give Roland and Yamaha 
a run for their money.

I am a qualified Accountant (and ex-pro drummer), I can develop 
business plans, budgets and forecast, establish costs and pricing - I 
also have the use of cutting edge marketing, warehousing and a supply 
chain into Europe off the back of the company that i am the 
accountant for (which is 3 miles from where Simmons were based - and 
I was a regular visitor).

is there anybody else that would like to carry the legacy forward for 
the sake of electronic drummers that haven't even been born yet?

Hm. First of all I do not have any commercial intention and I don't
want to mess with a musicstore chain as well. The 25% referred to a
couple of expandable parts like (as mentioned) e.g. shells which
cannot be replaced by any series products but that are exclusively
Simmons, or FSR foils for SDX pads which are not manufactured anymore.
I was simply thinking of spotting the demand for some major parts (to
mention again shells) in order to keep as many "originals" in good
shape as possible. And 100 blank shells are cheaper than 5 for my home
requirements.
But: You're invited to make a business plan. I don't know the demand
for a new developped Simmons like analog drum kit, but I prefer the
original ;-)
