What if your not professional and not using it on a pro job, but only using it
for your own personal non professional projects? And based on the cost to
profit ratio you wouldn't normally buy these CDs. Of course it is still
illegal, but is the crime then as "bad"?

I don't think the sample CD companies would agree with this. I don't think that
they have a policy of allowing non income generating project studios to use to
use their products at no charge.

By this reasoning though, how much income must you generate from your studio
before you begin to lose sleep at night over using unpaid for sample CDs? $100?
$500? $1,000, $5,000?

That doesn't mean it is not illegal though.

Interesting question. You're attaching a moral judgement - good or bad
- to a question of legal entitlement and in this case the two are
exclusive. It's like differentiating between 'being pregnant' vs.
'being a little bit pregnant'. You either have a licencse for the
sample cd or you do not.

In the privacy of your own home nobody is likely to care - but you
still don't have a licencse. If you can live with that, hypothetically
speaking of course, hey - more power to you. But that won't change the
fact that you're technically in violation of a licencsing agreement as
soon as you attempt to profit in any way from the original material.
While its unlikely charges would be filed - you shouldn't be surprised
when the court finds against you ;-)

Jon Levinson

p.s. - this is all hypothetical of course - I don't mean 'you' as in
Eli K.

I think you'd be in violation of the licensing agreement well before you "attempt to profit from
it". Even using it in a manner not attempting to generate profit is illegal.

I think you are correct - I should have taken an extra minute to
rephrase that.
