Hi everyone!

I'm sure I've seen mention of this before here, but it's worth re-
mentioning, the PlanetMellotron.com mellotron owners/players site.
It's got a most comprehensive list of owners and players, and what
instruments they used. I can tell the discography's aren't
necessarily complete, as far as the few that I've followed a bit,
such as Rick Wakeman, but I was greatly amused (and appreciative) to
find mention of some of my work on a 1980 album called "Nightwing." I
was referred to as "...the mysterious Berington Van Campen..." HA!
EXCELLENT! The reviewer went on to say I "played extra keys, as well
as writing 'Fantasia.' As a result, I assume it's him playing the
Mellotron flutes on both parts of his piece, plus occasional choirs
on 'You Keep Me Hanging On', although all the strings appear to be
real." In fact, the real strings were transcribed from my Mellotron
parts and mixed WITH them, not replacing them, which we loved doing,
and the title song "Something In The Air," was also done the same
way. Only exception was the end piece, where we did pull the
Mellotron flutes & violins, 'cause it was so cool to hear the real
string section floating from chord to chord without the melodies. For
the record, I also played a lot of synth and guitar stuff on there,
too, and arranged b/g vocals on the L.A-recorded songs.

Hey, if anyone wants to hear M-400 #1485 a little more currently, you
can check myspace.com/berington. It's on 3 songs, "Goes The Way It
Goes," "Hearing How You Breathe," and at the very end of "Waiting In
The Wings." Unfortunately, as I wrote when I first joined this group,
ol' #1485 is now on the blink. Needs serious motor work (ALMOST
frozen motor), and I'd suspect a good housecleaning. Just got a call
from a guy who wants some Mellotron on a session though, so I think
it's time to get 'er up 'n' runnin' again!

Anyway, thanks for the great, and so-often amusing site you guys
carry on here. It's excellent. I really DID write just to remind you
of the PlanetMellotron site, too. It's pretty interesting. Ah yes, as
a guitarist myself, I'd have to opine too, that Pete Townsend really
is a terrific guitarist & writer, certainly responsible for a ton of
iconic music and sounds. Too bad he wasn't sold on Mellotrons, but
hey, one or two more for the rest of us who WERE! Wouldn't want him
playing mine anyway; I'm sure his right hand fingers were thrashed
and bloody!

Is it still the case that any music (or anything else) uploaded to
MySpace becomes the property of Ruopert Murdoch's News Corp who now own it?

It certainly used to be the case; several musicians have been stung by
this one.

To "love the shit out of..." is a Hollywood expression, Mike. Is is a reflection of one's penetrating desire to give and take at the same time... with a chance for a chocolaty reward for being so thoughtful.

MySpace property (was Re: PlanetMellotron.com)

I checked this out a little while ago. It's not the case that NewsCorp own it, however for
them to be able to distribute your work (via the web) you do have to implicitly grant a
(non-exclusive) licence for them to use/modify/broadcast your content (music, text,
graphics, whatever) within the MySpace environment. Sounds drastic, but if you think
about it, they have to do all those things to distribute your tracks across the web.

But here's the relevant bit:

"Proprietary Rights in Content on MySpace.com.
MySpace.com does not claim any ownership rights in the text, files, images, photos, video,

"Content") that you post to the MySpace Services. After posting your Content to the
MySpace Services, you continue to retain all ownership rights in such Content, and you
continue to have the right to use your Content in any way you choose. By displaying or
publishing ("posting") any Content on or through the MySpace Services, you hereby grant
to MySpace.com a limited license to use, modify, publicly perform, publicly display,
reproduce, and distribute such Content on and through the MySpace Services. Without this

This claim is legally absurd, and would never stand up in court.
I mean ditto if I put some "small print" on a website that says "I am
allowed to murder anyone I like who reads this", this would be total
bollocks :)

Hey Mike!
WOW! First time I’ve heard that! Thank you for the most-serious “heads-up!” I know that MySpace was originally set up AS a musicians’ site, for the kind of indie promotion it’s so used for now. I’d be shocked to find that the case, but I can only say, any music I post is properly copyrighted first, through my publishing administrators (a huge international organization I’ve been with since 1975), and even corroborated with past video recordings over the last couple of years on logged, dated, live webcasts. If anyone were to try the infringement route, I could certainly back up my authorship and 100% ownership.
Thank you VERY much for the warning, though, Mike! Words worth paying CLOSE attention to. In fact, I’ll do what I can to investigate that, and let you know what I find. That would send serious chills thru the indie music community!

Thanks so much for your "Point-Counterpoint" look at what's in fact, a very important concept. I'm so glad you brought it up! It makes all the sense that we have to license all the rights we do, for the use of a piece of music, images, whatever, in order for them to process it in the first place. But it's also important to note that in the agreement it stipultaes no ownership or publishing rights, etc. are in fact, trasferred. It's only a license agreement. REALLY glad you've both added that question and answer to this issue!
I'm also glad to have stirred up a little more taunting humor between you guys! I don't often write, but I always read, and it's always good for a chuckle! What friends are for, electronically or otherwise!
