To get to trial, you need an indictment by a grand jury - so you must present enough evidence to convince them. And the grand jury proceedings can be secret or sealed. So, the US really has no obligation at all to present the Taliban with any evidence. But perhaps, they should present it to a sealed grand jury type of thing in a World Court somewhere... perhaps that's been done? In any case, Bin Laden has already been indicted in at least three bombings, so that's sufficient to arrest him.
