All of the code Myself, Mike Murphy and Mike Firman wrote is public  
domain.

Whatever "what's his name" says, he did not write it and has no  
authority to modify the public domain license.

We all have backups of our own code.

There is no reason to let "what's his name" block availability of a  
useful design.
That is not what intellectual property laws are for.
The courts do not uphold obstructive use of the law.
