Bernie has a standing offer posted on his website (

into a business agreement to offer electronic copies of his intellectual
property:
You will agree to the following: You will pay me $X on the signing of the

I see no evidence that Bernie has entered into such an agreement with
Henry, nor that he has given Henry permission to post copies of his
copyrighted work. Bernie's note to us was quite judicious, but unless or
until he states clearly that he has granted permission, Henry appears to be
just an infringing thief.
