They do not need to know.

They rely on your declaration, which better is telling the truth if you 
don't want to be subject to punitive damange in case they find out that 
you have been knowingly lying.

When it comes to the question "selling to the EU", RoHS probably is one 
of the smallest concerns. I'd consider WEEE a bigger one, especially the 
way it was installed, and also the recent change in package recycling 
law.
