IIRC the test in this country is whether your publication constitutes a 
"derivative work" - I think your proposed method would be very hard to 
defend against such a charge. For an example of a highly successful 
method for working round this sort of problem, have a look at Phoenix's 
reimplementation of the IBM PC BIOS in the early 80s.
