Actually, this is a wrong analogy.

If you want to go for the TV example, it's like TH having sold TVs in 
the past. People liked those very much, but finally, TH stopped selling 
them, leaving a market with demand without the product.

What that eBay guy is now doing is to clone that TV and sell clones of 
it. Doing so violates TH's intellectual rights, but it is nowhere near 
walking into TH's house and stealing *his* TV.
