Maybe they licensed the sounds from Roland, or were just lucky to escape
the Roland legal department's attention.
Maybe Roland have a license deal with someone for exclusive use in a
soft-synth of the 909 sounds.
One obvious candidate springs to mind...

Doubt it - there are no patents on the 303. Maybe it was just trademark
infringement on the tb303 name ?
But that's easily avoided.
