My opinion, for what it's worth... 

I really don't like the idea of threatening with nonexistant laws.
(Ie., copyright doesn't protect against someone going into production
with the physical device.)  Phrases like "restrictions apply",
"strictly forbidden", "express permission", "aforementioned data" and
so forth make us look like a sorry collection of wannabe lawyers.

(It also suggests a scary world where there are significant legal
limitations on information and ideas.)

I think the right thing is to acknowledge that there is some
innovative and useful material in the archive, and that if anybody is
persuing commercial applications it would be in their best interest to
contact the individual poster about consulting or licensing.
