well, i do tend to agree with that, don.
it would be nice, however, if a patent approved by the patent office was more protected. perhaps there should be 2 types of challenge to a patent.
1. if one ignores the patent and you sue them, tripple damages could be applied.
2. one could "challenge a patent" without infringing upon it (ie, they take you to court for patenting something they don't think is patentable). the damages in this type of challenge could be considerably less, reflecting the nature of challenging the patent before bringing a competing product to the marketplace.
a certificate from the patent office should protect you more than it does.
