If you read the article closely, the "new" contract only takes effect
when you agree to their terms if you *change* your web site. And
I  think they could never legally make this stick unless they did so.
So if you just take it down they would have no legal ownership of it.

knowledge and they realize what bad press it will give them. One
thing you *don't* want to have on the Internet is bad press.
